Stadium Regulations

Section 1 Geographical scope

1. These Stadium Regulations are valid for all sections of the VELTINS-Arena, the public transport station at Kurt Schumacher Strasse, the Parkstadion including access routes and green areas south of the A2 motorway, the car parking facilities north of Willy Brandt Allee and west of Adenauerallee.

The multiplex cinema, Sport Paradies, the Berger Feld Gesamtschule school, the rehab centre, the hotel as well as the emergency response centre are exempt. The scope is delineated by an uninterrupted line on the enclosed map, which is part of the Stadium Regulations.

The section of the VELTINS-Arena that is enclosed by a perimeter fence is delineated by a dashed line on the map.

2. The Stadium Regulations are valid on the relevant event days for all events that take place in the VELTINS-Arena or anywhere on the premises (car parks, public transport station).

Section 2 Authorized persons

Only persons in possession of a valid ticket or any other valid form of accreditation or who can prove in any other way that they are authorized to access the event in question are permitted access to the fenced-in area of the VELTINS-Arena on event days. Tickets or accreditation must be presented to the security staff employed by the event organizer, officials from the public order authority or the police and handed over to them for inspection on demand.

Section 3 Entrance controls

1. Upon entering the fenced-in area of the VELTINS-Arena, every visitor is required to present their ticket or accreditation to the security staff employed by the event organizer, officials from the public order authority or the police, without being prompted to do so, and to hand it over to them for inspection on demand.

2. Visitors who are unable to prove their right of admission or who have been banned, regionally or nationally, from sporting events in stadiums are not permitted to enter the premises. Access will be denied to those persons by the security staff employed by the event organizer, officials from the public order authority or the police or they will be expelled from the premises if they are encountered within the fenced-in area of the VELTINS-Arena.

3. Visitors who are clearly under the influence of alcohol or drugs or who carry weapons or dangerous objects as outlined in Section 5 and who refuse to allow those items to be confiscated by the security staff employed by the event organizer will also be barred from entering the stadium.

Visitors who are found to have blood alcohol levels exceeding 0.16% are generally prohibited from entering the VELTINS-Arena.

4. The security services staff employed by the event organizer are permitted – subject to the person in question giving their consent – to search the clothing or any other items in the possession of persons who are suspected, due to their behaviour or based on other evidence or conclusions, of being barred from visiting sporting events in stadiums on a local or national level, or of being under the influence of alcohol or drugs or carrying weapons or other dangerous objects pursuant to Section 5, to determine their levels of intoxication by using technical devices if required or to check their identity by inspecting valid ID in the case of a potential ban from stadiums, in order to clarify the situation.

5. Persons who do not give their consent pursuant to Section 4, Sentence 1 will be excluded from entering the fenced-in area of the VELTINS-Arena and asked to leave or will be expelled from the premises if they are encountered within the fenced-in area of the VELTINS-Arena.

6. The club FC Schalke 04 is explicitly opposed to xenophobic, racist, violence-glorifying, anti-Semitic, extreme left-wing and extreme right-wing tendencies.

Therefore, persons who, in particular based on their appearance, give the security staff reason to believe that they have extreme leanings, can be excluded from events.

Appearance in this context means especially typical items of clothing, often with certain types of lettering and certain combinations of numbers or letters printed on them that represent a certain mindset of the person wearing them. In addition, persons who express such extreme leanings via flags, propaganda material or chants can also be excluded from events.

Section 4 Behaviour within the area covered by the Stadium Regulations

1. Within the area covered by these Stadium Regulations, the behaviour of any person must not endanger or damage other persons or objects of considerable value and should not obstruct or disturb others, unless this is unavoidable due to the circumstances.

2. Everyone must follow the instructions given by the event organizer’s security services staff, the officials from the public order authority, the police, the fire department and the emergency services as well as the stadium announcer.

3. Visitors may sit only in their allocated seat and only use the relevant access routes on their way to get there. For security reasons and in order to prevent potential danger, visitors must take a different seat from the one printed on their ticket, which may be located in a different block of the stadium, if instructed to do so by the event organizer’s security services staff, the officials from the public order authority or the police.

4. All stairs and emergency access routes must be kept clear.

5. It is not permitted to stand in seated areas during an event.

6. For security reasons and in order to prevent potential danger, the VELTINS-Arena and the fenced-in area of the VELTINS-Arena are monitored by CCTV.

Section 5 Prohibited items

1. Visitors in the area covered by these Stadium Regulations must not carry the following items on their person:

a. weapons or other dangerous objects that may also cause injuries;

b. defensive weapons and/or protective clothing or items that may be used as defensive weapons and that are designed to protect from enforcement measures carried out by authorized staff under certain circumstances;

c. gas spray cans, corrosive or pigmenting substances, flammable liquids or pressurized containers for easily flammable or hazardous gases with the exception of common pocket lighters;

d. bottles (including plastic bottles), cups, jugs, cans or other containers that are made from fragile, splintering or particularly hard material; non-alcoholic drinks in “Tetra-Paks” of up to 0.5 litres are permitted;

e. bulky objects like ladders, stools, chairs, boxes, suitcases;

f. fireworks, including rockets, Bengal lights, smoke powder, smoke bombs, flares and other pyrotechnical items;

g. flag or banner poles that exceed two metres in length and three centimetres in diameter as well as large banners, two-poled banners and large paper or wallpaper rolls;

h. mechanically or electrically driven noise instruments;

i. devices for noise or voice amplification;

j. laser pointers;

k. alcoholic drinks of any kind;

l. drugs;

m. animals;

n. violence-glorifying, xenophobic, racist, anti-Semitic, extreme left-wing or extreme right-wing propaganda material;

o. other objects that are designed to or can be used to cause harm to persons or property damage;

p. objects that can be used and may be intended to prevent the authorities from establishing the identity of a person;

q. photo and video cameras as well as other devices for recording sound or images intended for commercial use (unless explicitly permitted by the event organizer);

r. fan accessories if these are used to provoke other fan groups.

2. In addition, visitors are prohibited from:

a. climbing or walking onto or climbing over buildings and facilities that are not intended for general use, especially façades, fences, walls, cornices, pitch boundaries, barriers, lighting systems, camera platforms, masts of all kind, roofs including rigging gear and anchors, trees, hedges or green verges on the roadside or planted areas of all types;

b. entering areas that are marked as not permitted for visitors, as well as occupying locations or places that are not intended for that purpose by the event organizer;

c. erecting, mounting or storing objects;

d. staying overnight;

e. climbing onto seats;

f. rolling out banners for the purpose of concealing prohibited actions;

g. throwing objects;

h. lighting fires, fireworks, rockets, Bengal lights, smoke powder, smoke bombs, flares and other pyrotechnical items or assisting or inciting others to do so;

i. offering and selling goods, handing out printed material, collecting money or selling tickets without the necessary licences from the relevant authorities and the explicit permission of the event organizer;

j. writing on, painting on, sticking posters to, scratching, corroding or damaging in any way buildings, facilities, trees or walkways and driveways;

k. relieving themselves outside of the toilet facilities or polluting the stadium facilities in any other way, especially by littering;

I. uttering or spreading violence-glorifying, xenophobic, racist, anti-Semitic, extreme left-wing or extreme right-wing slogans as well as discriminating against sections of the population through verbal abuse, gestures or other types of offensive behaviour;

m. attending the event in attire that can be used and may possibly be intended to prevent the authorities from establishing the identity of the wearer;

n. carrying weapons or objects that are designed or can be used to cause harm to persons or damage to property;

o. carrying objects that can be used and may be intended to prevent the authorities from establishing the identity of a person (ban on face coverings).

3. It is prohibited to offer, sell or hand over to others in any other way items that are prohibited by the Stadium Regulations within the area covered by the Regulations.

4. Furthermore, it is prohibited to obstruct traffic areas, in particular walkways and driveways and to erect sales stalls on green areas.

5. It is also prohibited to form a riotous assembly at events or in the vicinity pursuant to these Stadium Regulations. A riotous assembly is defined as several persons assembling unlawfully with a discernible intention of disturbing the peace.

Section 6 Violations

1. Persons violating Section 5 of these Stadium Regulations with wilful intent or negligently can be expelled from the VELTINS-Arena and its vicinity without compensation or a refund of the admission fee. The same applies to persons who are discernibly under the influence of alcohol or drugs.

2. Persons who are in breach of the Stadium Regulations inside or outside of the stadium in connection with an event can be barred from the stadium. Depending on the severity of the offence, this stadium ban may apply to the area of the VELTINS-Arena only or to all stadiums in Germany.

3. Should the event organizer be held liable for damages or subjected to fines from third parties (DFB, UEFA, FIFA and others) due to visitor behaviour in breach of the regulations, those responsible will be held liable by way of recovery.

4. Visitors who are suspected of having committed a criminal offence will be formally reported to the authorities. In cases of minor offences, the person in question may also be reported to the authorities.

5. Contraband items will be confiscated and kept in storage and, if not required as evidence in a civil or criminal case, returned to the person from whom they were confiscated when the reasons for the confiscation are no longer valid. Items listed under Section 5, Paragraph 1, Letters a, b, f, l, n will not be returned.

6. Persons who do not follow the instructions given by the security staff employed by the event organizer, the police, the fire department, the emergency services or the stadium announcer contrary to Section 4 Paragraph 2, or who obstruct stairs or emergency routes contrary to Section 4 Paragraph 4, are also committing an offence.

Section 7 Contractual penalties

Visitors must pay a contractual penalty in the amount of €25 to the event organizer if they

– urinate on the premises of the VELTINS-Arena or inside the VELTINS Arena outside the designated toilet facilities,

– throw empty or filled drink cups, lighters, coins or other items that might cause injury to a person who is hit by them in the direction of the playing field or other persons,

– stick posters, flyers or stickers to parts of buildings or other elements of the VELTINS-Arena (e.g. fences, flagpoles, bins, signs etc.) on the grounds of the VELTINS-Arena or inside the VELTINS-Arena,

– smoke inside the designated non-smoking areas on the premises of the VELTINS-Arena or inside the VELTINS-Arena.

Should a visitor carry pyrotechnical items (e.g. rockets, flares) onto the premises of the VELTINS-Arena or inside the VELTINS-Arena, he will incur a contractual penalty in the amount of €1,000 payable to the event organizer. The same penalty applies if the visitor lights pyrotechnical items or assists others in doing so.

Further claims for damages, injunctive relief or other contractual claims remain unaffected.

Section 8 Liability of the event organizer

1. The liability of the event organizer, its legal representatives and agents for damages from injury to life, body or health as well as liability pursuant to the product liability law is not restricted by the Stadium Regulations.

2. The event organizer cannot be held liable for damages other than those listed in Paragraph 1 unless the damages are due to:

a. cases of intentional or grossly negligent breach of duty on the part of the event organizer, its legal representatives and agents or

b. the breach of an obligation that is essential for fulfilling the purpose of the contract. In the case of the breach of an essential contractual obligation, the event organizer’s liability is limited to typically foreseeable damage.

3. Release from liability pursuant to Paragraphs 1 and 2 shall also apply to liability by the agents and legal representatives of the event organizer.

4. Accidents or damage must be reported to the event organizer without delay.

Section 9 Image and sound recordings

1. Every visitor to an event in the VELTINS-Arena consents to the event organizer and/or third parties commissioned by it having the right to make image and sound recordings of the visitors during the event, to reproduce and transmit them as well as to publish them in any audiovisual media, without any obligation on the part of the event organizer to compensate the visitor.

2. The rights of the event organizer from Paragraph 1 shall apply without any time limit and worldwide.

Section 10 Exceptions

By agreement with the event organizer and the police, permission may be granted to individual visitors to the VELTINS-Arena to carry flags that are bigger than stipulated in Section 5 Sentence 1g. Furthermore, the event organizer reserves the right to make exceptions with regard to large banners and/or megaphones/drums in agreement with the police in individual cases. This requires an advance application to the event organizer by the visitors in question.

Section 11 Equality in the use of language

Terms and pronouns used to describe persons always apply both to male and female persons.

Section 12 Final provisions

These Stadium Regulations are effective from July 2012.
